Terms & conditions

Agreement
These terms are between you and Rummage limited (“Rummage”, “we”, “us”) and govern your use of rummage.nz. By creating an account, listing items, or buying through the service, you agree to these terms and our Privacy policy.
If you do not agree, do not use Rummage.
Eligibility
- You must be at least 18 years old (or the age of majority in New Zealand).
- The service is for users in New Zealand only.
- You must provide accurate registration information.
What Rummage is
Rummage is an online second-hand goods marketplace that helps sellers create sales and share links, and helps buyers view items, ask questions, make offers, and purchase.
Rummage is not the seller of items listed by users. Contracts for the sale of goods are between the buyer and the seller. We do not guarantee the quality, safety, legality, or delivery of any item.
For now, sales are link-only. There is no public browse or search of all listings on the site.
Second-hand goods and personal surplus
Rummage is a marketplace for:
- Second-hand goods that have previously been owned or used. Individuals and businesses may acquire second-hand goods for resale, including from overseas.
- New or unused personal-surplus items that were originally acquired for personal or household use—for example, an unwanted gift, a duplicate, or something that was never used.
You must not list new or unused goods acquired from manufacturers, wholesalers, online suppliers, or similar sources as stock for resale. This includes new stock sourced through marketplaces such as Temu or AliExpress.
Dropshipping and the sale or third-party fulfilment of new resale stock are not permitted. We may remove listings and restrict or terminate accounts that breach these rules.
Seller responsibilities
- Provide accurate titles, descriptions, photos, condition information, prices, and fulfilment options.
- Only list items you own or otherwise have the legal right to sell.
- Do not list prohibited, unsafe, or illegal goods.
- Respond to questions and offers in good faith.
- Honour accepted offers and completed sales.
- If you are in trade under New Zealand law, clearly identify yourself as a trader and meet all applicable consumer-law obligations. Private sales may not carry the same consumer protections.
- To accept card payments, maintain a valid Stripe Connect account in good standing.
Buyer responsibilities
- Pay the agreed price using a method the seller accepts.
- Provide accurate contact and delivery details when requested.
- Complete Stripe Checkout promptly when paying by card.
- Arrange pickup or shipping as agreed with the seller.
- Do not misuse questions, offers, or reports.
Payments
Card payments are processed by Stripe on the seller’s connected Stripe account. Funds settle to the seller per Stripe’s terms. Rummage does not hold item-sale proceeds.
Cash and bank transfer are arranged directly between buyer and seller. Rummage does not verify that offline payment has been made. Bank details may be shared in notifications after a purchase or accepted offer.
Guest buyers may use Buy Now with card only; email is collected in Stripe Checkout.
Ordinary second-hand sales are free on Rummage (no listing or transaction fee at launch). Stripe charges its own processing fees on card sales, paid by the seller and not returned if the sale is refunded. We may introduce fees for future product types with notice.
Refunds & disputes
The contract for the sale of an item is between the buyer and the seller. Buyers should contact the seller first about problems with an item, delivery, or payment.
A buyer’s legal rights depend on the circumstances of the sale. If the seller is in trade, rights and remedies under the Consumer Guarantees Act 1993 and Fair Trading Act 1986 may apply, including rights to a repair, replacement, refund, cancellation, or compensation. These statutory rights are not limited by a seller’s returns policy or by Stripe’s terms. Private sales are generally not covered by those Acts, but buyers and sellers may still have rights and obligations under the sale contract and other New Zealand law.
For card payments, a seller may issue a refund through Stripe. Stripe does not return its processing fee when a payment is refunded, so the seller bears that fee. A buyer may also be able to ask their card issuer about a chargeback. Chargebacks are governed by the applicable card-provider rules and are separate from any legal rights the buyer or seller may have.
Except where required by law, or where a claim arises from Rummage’s own services, conduct, or obligations, Rummage is not responsible for deciding or funding refunds for transactions between buyers and sellers and is not required to mediate their disputes. Nothing in these terms excludes or limits any right or remedy that cannot lawfully be excluded.
If the buyer and seller cannot resolve a dispute, either party may pursue any remedy available through the Disputes Tribunal or the New Zealand courts.
Listings, offers & questions
- Sellers control their sales and may edit, end, or remove listings subject to these terms.
- Items may expire automatically if an expiry date is set.
- When an item is sold, other pending offers may be closed.
- Only one pending offer per buyer per item is allowed.
- Question and offer visibility follows the rules shown in the product (e.g. answered questions are public).
Prohibited use
You must not:
- list stolen, unsafe, or illegal goods;
- list dropshipped goods, import-for-resale stock, or new items sourced from suppliers to sell on Rummage;
- misrepresent items or impersonate others;
- harass users or post abusive content;
- attempt fraud, scraping, or circumvention of security;
- use the service for any unlawful purpose.
Users may report listings. Categories include inappropriate content, prohibited items, misleading listings, and suspected scams.
Moderation
We may remove, place on hold, or restrict listings and accounts that breach these terms or create risk for users. Sellers are notified when an administrator on-holds or deletes a listing.
We are not obliged to monitor all content before publication.
Intellectual property
You retain ownership of content you upload. You grant Rummage a licence to display it on the service for the purpose of operating your listings. You confirm you have the right to use photos and text you upload.
The Rummage name and branding may not be used in a misleading way.
Disclaimer & liability
The service is provided to the extent permitted by law. To the maximum extent permitted by New Zealand law, Rummage is not liable for user-to-user transactions, offline payments, item quality, or losses arising from your use of the platform.
Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 where they apply to services Rummage supplies to you as a platform user. We do not exclude liability that cannot be excluded by law.
Termination
You may stop using Rummage at any time. We may suspend or terminate access if you breach these terms. Account deletion and data handling are described in our Privacy policy.
Changes
We may update these terms. The “Last updated” date will change when we do. Continued use after changes take effect constitutes acceptance of the updated terms, to the extent permitted by law.
Governing law
These terms are governed by the laws of New Zealand. Disputes with Rummage are subject to the exclusive jurisdiction of the New Zealand courts.
